  • This page sets out the terms and conditions for use of the TRACKER website pages at www.tracker.co.uk (our site). Please read these terms and conditions carefully before you start to use our site. By using our site, you indicate that you agree to the terms of use in force at that time. If you do not agree to these terms and conditions, please do not use our site.
  • Information about us
  • Our site is operated by TRACKER Network (UK) Limited ("we", “us” or “our”). We are registered in England and Wales under company number 02632771 and have our registered office at Otter House, Cowley Business Park, High Street, Cowley, Uxbridge, Middlesex UB8 2AD. We are a member of The Royal Bank of Scotland Group.
  • Accessing our site
  • Access to our site is permitted on a temporary basis. We reserve the right to withdraw or amend the service we provide on our site without notice.
  • Availability of our site
  • Access to our site may also be suspended temporarily and without notice in the case of a system failure, maintenance or repair or for reasons beyond our control. TRACKER reserves the right to limit your access to our site in the event of any reported vehicle theft.
  • Each registration is for a single user only. You must treat your login details as confidential and must not disclose it to any other person nor with other users on a network. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these terms and conditions.
  • Acceptable use policy
  • When using our site, you agree to comply with the acceptable use policy set out below and you agree to indemnify us in full against all direct or indirect liabilities (including, without limitation, financial loss, loss of profit, loss of business, loss of reputation, depletion of goodwill and like loss), loss, fines, penalties, damages, injury, costs and expenses (including legal and other professional fees and expenses) awarded against or incurred or paid by us arising as a result of a failure by you to comply with this acceptable use policy.
  • TRACKER provides tracking, recovery and repatriation in partnership with local authorities. UNDER NO CIRCUMSTANCES SHOULD OUR SITE BE USED TO PURSUE RECOVERY OF A STOLEN VEHICLE. IN THE EVENT OF VEHICLE THEFT CONTACT YOUR LOCAL LAW ENFORCEMENT AGENCY AND THEN TRACKER.
  • You may use our site only for lawful purposes. You must:
    • first obtain the consent of any individual that uses the tracked vehicle before monitoring their use of the vehicle with our website; and
    • notify us promptly if you sell or otherwise dispose of any vehicle that you are able to monitor with our site.
  • You may not use our site:
    • to track vehicles that you suspect may have been stolen;
    • to gather information relating to a vehicle you do not own;
    • in any way that breaches any applicable local, national or international law or regulation;
    • to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware;
    • to reproduce, duplicate, copy or re-sell any part of our site in contravention of the provisions of these terms of use; or
    • to access without authority, interfere with, damage or disrupt:
      • any part of our site including parts provided or sourced from third parties;
      • any data on our site that relates to a vehicle that you do not own;
      • any equipment or network on which our site is stored;
      • any software used in the provision of our site; or
      • any equipment or network or software owned or used by any third party.
  • We will determine, in our discretion, whether there has been a breach of this acceptable use policy through your use of our site.
  • Failure to comply with this acceptable use policy constitutes a material breach of these terms of use, and may result in our taking all or any of the following actions:
    • immediate, temporary or permanent withdrawal of your right to use our site;
    • legal action against you to including to enforce the indemnity set out above; and
    • disclosure of such information to law enforcement authorities as we reasonably feel is necessary.
  • Exclusion of Liability
  • This section should be read carefully as it excludes or limits our legal liability in connection with your use of our site. Nothing in these terms of use attempts to exclude liability that is not permissible under applicable law, including without limitation, for death or personal injury, or for fraudulent misrepresentation.
  • While we have taken all reasonable steps to ensure the accuracy and completeness of the content of our site, we exclude any warranties, undertakings or representations (either express or implied) to the full extent permitted under any applicable law, that our site or (including without limitation) all or any part of the content or materials, accuracy, availability or completeness of the content of our site or any part of the content or materials are appropriate or available for use either in the United Kingdom or in other jurisdictions. If you use our site from other jurisdictions, you are responsible for compliance with applicable local laws.
  • We accept no liability in contract, tort, negligence, statutory duty or otherwise (to the maximum extent permitted by any applicable law) arising out of the use of or access to our site (which includes without limitation) any errors or omissions contained in our site (or if the site is unavailable) and we shall not be liable for any direct or indirect:
    • economic losses (including without limitation loss of revenues, data, profits, contracts, use, opportunity, business or anticipated savings);
